Extraordinary session passes bill requiring settlement funds to be deposited in the general fund and not the common school fund

The package of legislation passed early the morning of Dec 5 in extraordinary session by the Wisconsin Legislature contains the language that would require that the Wisconsin Department of Justice (DOJ) to deposit all settlement funds into the general fund and further, that all unencumbered settlement funds that are currently in the DOJ appropriation would lapse into the general fund.

WASB and others asked lawmakers to remove that language based on our view that those funds are arguably constitutionally required to be deposited into the common school fund established by Wisconsin’s original state constitution.  Read more on our position here.  WASB is asking Governor Scott Walker to veto the bill that contained these provisions. WASB weighs in on extraordinary session legislation relating to settlement proceeds and the common school fund

The WASB sent a memo to the Joint Finance Committee in advance of their public hearing on extraordinary session legislation on Dec. 3.  The WASB has strong concerns about provisions that would require that the Wisconsin Department of Justice (DOJ) must deposit all settlement funds into the general fund and further, that all unencumbered settlement funds that are currently in the DOJ appropriation would lapse into the general fund.

These concerns are based on the recognition that these provisions would formalize a process which, in our view, may violate Article X, Section 2 of the Wisconsin Constitution. Committee studying Common School Fund to meet Nov. 14

The Legislative Council Study Committee on the  Investment and Use of the School Trust Funds will hold its next meeting Nov. 14, 2018 at 9:00 a.m., in Room 411 South, State Capitol.

The School Trust Funds under study by this committee include the Common School Fund, which provides the income from which Library Aids for public school libraries are generated.

The materials for this meeting  have been posted to the committee’s webpage, including the minutes of the committee’s October 11, 2018 meeting.

Study committee on Common School Fund to meet on Oct. 11

The Legislative Council Study Committee on the Investment and Use of the School Trust Funds is scheduled to hold its third public meeting on Thursday, October 11 at 10:00 a.m., in Room 411 South, State Capitol.

The Study Committee is directed to review the statutes governing the investment of the trust funds administered by the Board of Commissioners of Public Lands (BCPL), including the loan programs administered by BCPL. The Study Committee is further directed to assess whether current statutes adequately ensure the effective investment and appropriate use of the proceeds of the funds, and recommend legislation for necessary changes.

Some Study Committee members have expressed concerns about the BCPL’s State Trust Fund Loan Program and its effect private lending to municipalities and school districts. Possible discussion topics relating to these concerns include, among others:

o   capping the portion of the school trust funds that the BCPL that may be invested through the loan program;
o   prohibiting the issuance of loans with features that private lenders are unable to offer or requiring that the BCPL serve as a “lender of last resort”; and
o   measures intended to increase the return achieved through the loan program itself.

Study committee on school trust funds to meet Sept. 5

The second meeting of the Legislative Council Study Committee on the Investment and Use of the School Trust Funds is scheduled to be held on Wednesday, September 5, at 10:00 a.m., in Room 411 South, State Capitol, Madison. You can watch the meeting LIVE on WisconsinEye.

This Study Committee is reviewing the statutes governing the investment of the trust funds administered by the Board of Commissioners of Public Lands (BCPL).  This includes the Common School Fund from which aids for public school libraries are generated.  The Study Committee is also reviewing the statutes governing the loan programs (e.g., the State Trust Fund Loan Program) administered by BCPL. Study committee on use and investment of Common School Fund to meet Thursday

The Legislative Council Study Committee on the Investment and Use of the School Trust Funds will hold its first meeting on Thursday (August 16) at 10:00 AM in Room 411 South, State Capitol.  The hearing will be broadcast live on Wisconsin Eye.  A panel of school leaders (school board members and school administrators) is scheduled to testify beginning at 2:40 p.m. (You can view the agenda here.)
